Q: Who is required to apply for a Manufacturing License?

to apply for a manufacturing license for approval by the Ministry of International Trade and Industry (MITI), through applications made to Malaysia Investment Development Authority (MIDA), an official agency under MITI in charge of the promotion and coordination of industrial development in Malaysia.
Q: I have less than 75 workers and the shareholders’ fund has not reached RM 2.5 million. Should I apply?
A company with a paid-up capital lesser than RM2.5 million or with workers lesser than 75 people may apply for a confirmation letter that the company is exempted from manufacturing license approval. The application should be submitted to MIDA.
Q: Is it important to apply for a Manufacturing License?
MIDA requires manufacturers to present their manufacturing license to obtain an exemption for import duty tax on raw materials and components used in the production of finished goods.
There will be additional advantages for applications that have Pioneer Status or Investment Tax Allowance. Businesses with Pioneer status can get a tax exemption from 70% up to 100% of statutory income for 5 to 10 years.
Q: What is LMW?
Licensed Manufacturing Warehouse (LMW) is a warehouse license under the provision of section 65/65A of the Custom Act 1967, Malaysia. The purpose of LMW is to give Custom duty exemption to raw materials/ components and machineries and equipment which used directly in the manufacturing process of approved produce from first stage of manufacturing till finished product is finally packed ready for export.
Q: Can my company apply for one?
The criteria that must be fulfilled to apply a licensed manufacturing warehouse as stated below:

Manufacturers who own a Manufacturing License under the Industrial Co-ordination Act 1975 (ICA) or have an exemption letter issued by the Malaysian Investment Development Authority (MIDA)

Manufacturing that conforms to the manufacturing interpretation of Section 2 (1), the Custom Act 1967

Manufacturers that exporting more than 80% of total value of finished goods for 12 months
-
Manufactured goods that are excised duty such as vehicles, cigarettes, liquor and petroleum/ petroleum product are not eligible to apply LMW facilities.
